Terms of Service

1. Acceptance of Terms
By accessing or using MenuAdvisor (“MenuAdvisor”, “we”, “us”, “our”, or the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. The Service
MenuAdvisor provides a one-time, AI-assisted menu performance report based on menu information you submit. Reports are generated automatically and delivered digitally.
MenuAdvisor does not provide:
- professional consulting services,
- financial, legal, tax, or accounting advice,
- guarantees of revenue, profitability, or business outcomes.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service.
4. User Submissions
You may submit menu content via:
- a public URL, or
- file upload (e.g., PDF, image).
By submitting content, you represent that:
- you have the right to use and submit the content, and
- the content does not violate any laws or third-party rights.
You retain ownership of your content. However, you grant MenuAdvisor a limited, non-exclusive, worldwide license to host, store, reproduce, and process your submitted content solely to operate the Service and generate and deliver your report.
You are responsible for the accuracy and completeness of the information you submit.
5. AI Output & Disclaimers
Reports are generated using automated systems and are provided for informational purposes only.
- Insights are based on inferred menu structure and internal consistency.
- Pricing insights are not market benchmarks and may not reflect local competitor pricing.
- If you provide location or restaurant context, it is used only to refine assumptions.
- AI outputs may contain errors, omissions, or outdated assumptions.
You acknowledge that:
- results may vary,
- recommendations are not guarantees, and
- you are solely responsible for business decisions made based on the report.
6. Payments
- All purchases are one-time payments per report.
- Prices are displayed before checkout and may change at any time.
- Payments are processed by third-party payment providers (e.g., Stripe). We do not store full payment card details.
- You are responsible for any taxes that may apply.
7. Delivery & Access
Reports are digital products and are considered delivered when we:
- display the report on-screen, and/or
- send an email containing a secure link to access the report.
You are responsible for:
- providing a valid and correctly spelled email address, and
- ensuring that you can receive emails from us (including checking spam or promotions folders).
If you do not receive the email, you must contact support@menuadvisor.co. We will resend access to the report at no additional cost.
Failure to receive an email due to an incorrect email address, mailbox filtering, or user-side issues does not constitute non-delivery once the report has been generated and the delivery attempt has been made.
8. Refunds
Because reports are generated on demand and delivered digitally, all sales are generally final.
Refunds may be issued only if:
- we fail to generate the report due to a verified technical error, and
- we are unable to provide the report after reasonable attempts to resolve the issue.
Refunds are not provided for:
- dissatisfaction with AI-generated insights or recommendations,
- incorrect, incomplete, or unreadable menu files submitted by the user,
- failure to receive the report due to an incorrect email address or email filtering,
- delays caused by third-party services outside our control.
Before initiating a chargeback, you agree to contact support@menuadvisor.co so we can resolve the issue. In most cases, we can resend access to your report immediately.
We reserve the right to refuse refunds in cases of suspected abuse, repeated refund requests, or chargeback misuse.
9. Digital Fulfillment Acknowledgment
By purchasing a report, you acknowledge that:
- the product is a digital service that is fulfilled automatically,
- fulfillment begins immediately after payment, and
- once the report is generated and delivery is attempted, the order is considered fulfilled.
You also agree that access to the generated report constitutes delivery of the purchased service.
10. Prohibited Use
You may not:
- misuse, abuse, or disrupt the Service,
- attempt to bypass security or access restrictions,
- reverse engineer or attempt to extract source code (except to the extent allowed by law),
- submit malicious, unlawful, infringing, or harmful content,
- use the Service to build or train a competing product using automated scraping or bulk extraction.
11. Intellectual Property
The Service, including branding, site content, and report formatting/presentation (excluding your menu content), is owned by MenuAdvisor and protected by applicable laws.
You may use your generated report for your own business purposes. You may not resell the Service or present the Service as your own.
12. Suspension & Termination
We may suspend or terminate access to the Service at any time if we believe you violated these Terms or used the Service in a harmful or unlawful way.
13. Limitation of Liability
To the maximum extent permitted by law, MenuAdvisor is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business.
To the maximum extent permitted by law, MenuAdvisor’s total liability for any claim relating to the Service will not exceed the amount you paid for the report that gave rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnity
You agree to indemnify and hold MenuAdvisor harmless from claims, damages, and expenses arising out of your misuse of the Service or your violation of these Terms, including claims that your submitted content infringes a third party’s rights.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after updates become effective constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of Canada and the laws of the Province of Ontario, without regard to conflict of law principles.
